Terms of Service & End-User Agreement
This Terms of Service and End-User Agreement ("Agreement") is a legal agreement between you ("User" or "You") and the TALAS Capstone Project Team, Don Mariano Marcos Memorial State University (DMMMSU) Mid-La Union Campus ("We," "Us," or "Our"), regarding your use of the TALAS: Data Analytics for Reading Comprehension Assessment in Filipino web-based system (the "System" or "TALAS").
1. Acceptance of Terms
By creating an account, logging in, or using TALAS in any manner, you agree to be bound by this Agreement and our Privacy Policy, which is incorporated herein by reference.
2. Definitions
- • TALAS: Refers to the web-based platform designed for administering reading comprehension assessments, analyzing student data, and generating reports for educational purposes.
- • User: Refers to any individual authorized to use the System, including but not limited to administrators, teachers, school officials, and IT personnel from the Department of Education (DepEd) and La Union National High School (LUNHS).
- • Student Data: Refers to any information, including personal information and assessment results, directly provided by or about students (e.g., Grade 11 and 12 learners of LUNHS) through the use of the System.
- • Content: Refers to all information, text, graphics, reading materials, assessment questions, data, and other materials made available through the System.
3. User Accounts and Eligibility
3.1. Eligibility:
Access to TALAS is restricted to authorized personnel involved in the reading assessment program as defined by DepEd Region 1 and the administration of LUNHS. You must be granted explicit permission by your institutional administrator to create an account.
3.2. Account Responsibility:
You are responsible for maintaining the confidentiality of your login credentials (username and password). You agree to accept responsibility for all activities that occur under your account.
3.3. Accurate Information:
You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
4. Acceptable Use
You agree to use TALAS solely for its intended educational and administrative purposes related to reading comprehension assessment. You expressly agree not to:
- Use the System for any illegal or unauthorized purpose.
- Share your login credentials with any unauthorized person.
- Upload, post, or transmit any content that is unlawful, harmful, or infringes on any intellectual property rights.
- Attempt to probe, scan, or test the vulnerability of the System or breach any security or authentication measures.
- Use any automated system, including "robots," "spiders," etc., to access the System.
- Interfere with or disrupt the integrity or performance of the System.
5. Data Privacy and Confidentiality
5.1. Commitment to Privacy:
We are committed to protecting the privacy and security of all User and Student Data. Our collection, use, and disclosure of personal information are governed by the Philippine Data Privacy Act of 2012 (Republic Act No. 10173).
5.2. Nature of Data:
The System will process personal information of students and educators, including names, school information, and assessment results.
5.3. Purpose and Use:
Data collected is used strictly for the purposes of:
- Administering reading comprehension assessments.
- Generating analytical reports on student and group performance.
- Facilitating educational interventions and research within the scope of this capstone project.
5.4. Access and Disclosure:
Data will only be accessible to authorized users (e.g., teachers, school coordinators, district and division officials) based on their role. We will not sell, trade, or otherwise transfer Student Data to third parties for commercial purposes. Data may be disclosed only as required by law or as necessary for the System's educational purposes to authorized DepEd personnel.
5.5. Data Retention:
Data will be retained only for the duration of the capstone project and its evaluation period, after which it will be securely anonymized or deleted in accordance with DepEd guidelines and the Data Privacy Act.
6. Intellectual Property
6.1. System IP:
The TALAS platform, including its source code, design, graphics, and unique features, is the intellectual property of the TALAS Capstone Project Team and DMMMSU.
6.2. Assessment Content:
The reading passages, questions, and assessment rubrics are based on DepEd curriculum standards. The copyright for this content remains with the Department of Education. The TALAS team has permission for its use within the System for the purposes of this study.
6.3. User License:
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the System for its intended educational purposes during the project period.
7. Disclaimer of Warranties and Limitation of Liability
7.1. "As Is" Basis:
TALAS IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the System will be uninterrupted, error-free, or completely secure.
7.2. Capstone Project Nature:
You acknowledge that TALAS is a capstone project under development and may contain bugs or errors. It is not yet a commercially deployed product.
7.3. Limitation of Liability:
To the fullest extent permitted by law, the TALAS Capstone Project Team, its members, advisors, and DMMMSU shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the System.
8. Term and Termination
This Agreement is effective upon your first use of the System and remains in effect until terminated. We reserve the right to suspend or terminate your access to the System at any time, with or without cause, and with or without notice, especially upon the conclusion of the capstone project.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes shall be brought before the courts of the City of San Fernando, La Union.
